MUSLIM GIRL FREE TO MARRY ON ATTAINING PUBERTY, SAYS PUNJAB AND HARYANA HC ON PLEA BY 17-YEAR-OLD


A muslim young lady is allowed to wed anybody of her decision once she accomplishes pubescence, the Punjab and Haryana High Court has said while requesting the police to secure a 17-year-old Muslim young lady who wedded a 33-year-old Hindu man against the desires of her family.

Equity Harnaresh Singh Gill mentioned the objective fact while hearing an assurance request documented by the couple, who wedded according to Muslim customs.

"The law is evident that the marriage of a Muslim young lady is represented by the Muslim Personal Law. According to Article 195 from the book, 'Standards of Mohammedan Law by Sir Dinshah Fardunji Mulla', Petitioner No.1 (young lady) being 17 years old, is skilled to go into an agreement of marriage with an individual of her decision. Candidate No. 2 (her accomplice) is expressed to be around 33 years of age. Hence, Petitioner No. 1 is of eligible age as visualized by Muslim Personal Law," a report in Times of India cited from the adjudicator's perception.

The couple's dispute was that according to the Muslim Personal Law, pubescence and larger part are something similar and saw to be achieved at 15 years.
