MINISTER'S SON, WHO WAS CHARGED WITH RUNNING OVER FARMERS IN UTTAR PRADESH, HAS BEEN RELEASED

The main accused in the killing of protesting farmers in UP's Lakhimpur Kheri
last year, Ashish Mishra, the son of Union Minister Ajay Mishra, has been
released from prison. He fled prison via the back gate in an SUV - not standard
practise for other convicts Avdesh Kumar Singh, Ashish Mishra's lawyer, said
the court had asked for two sureties of Rs. 3 lakh apiece but had not placed
any limits on him leaving the city. The Allahabad High Court granted him bail
last week after lower courts had denied his appeals.
The
court had questioned some of the allegations listed by the police, including
firing at protestors, in a contentious order. "...no such firearm injuries
were located on the bodies of any of the deceased or on the bodies of any
injured individual during the course of the investigation," the court
stated. The judge also called into question police assertions that Ashish
incited the SUV driver to run down the farmers. The court also stated that
Ashish Mishra appeared before the investigating officers when summoned (he had
previously ignored summons) and that a charge sheet had been filed.The court
stated, "In such circumstances, this court believes the petitioner is
entitled to release."
When
NDTV questioned about his son's bail, his father, Union Minister Ajay Mishra,
merely grinned. Aday after his son was released on bail, the minister began
campaigning for the BJP.Farmers and opposition leaders were outraged by Ashish
Mishra's release on bail. The Samyukt Kisan Morcha, an umbrella body of farmer
unions that battled against the farm legislation, would file an appeal in the
Supreme Court "soon," according to farmer activist Rakesh Tikait, who
spoke to NDTV today.
Farmers
believe that police were persuaded to weaken the case, which resulted in Ashish
Mishra's release on bail. Priyanka Gandhi Vadra of the Congress and Jayant
Chaudhary of the RLD, as well as Mahua Moitra of the Trinamool Congress and
Mehbooba Mufti of the PDP, have all spoken out.
The
release of Ashish Mishra comes as the BJP-ruled state of Uttar Pradesh votes in
a seven-phase Assembly election. Two phases have come to an end. The third will
take place on Sunday. On February 23, Lakhimpur will vote in the fourth phase
of the election. On October 3, Ashish Mishra allegedly drove a Mahindra Thar
into four farmers and a journalist during a protest march in Lakhimpur Kheri
against three (now repealed) farm laws.
After the
Supreme Court intervened, he was detained few days later; the court ordered a
probe after the police and administration were accused of dragging their feet
on the investigation.Videos of the automobile crashing into farmers went viral,
inciting outrage and harsh criticism of UP Chief Minister Yogi Adityanath and
his cabinet, as well as Prime Minister Modi. In his first public statement on
the event, Prime Minister Narendra Modi said last week that the Uttar Pradesh
administration is "working transparently" on the subject.
On
that day, eight people were killed, including two BJP workers who were killed
in the ensuing violence. In November, after farmers' rage became a major
concern for the BJP (especially with elections nearing), PM Modi announced the
repeal of the farm rules, putting an end to an 11-month protest.
